Abstract

This study aims to analyze the suspension of civil prison, in the period of health emergency, due to the pandemic caused by the human coronavirus – called COVID-19 –, based on the comment to Habeas Corpus n. 580.261/MG, of the Superior Court of Justice. With the suspension of compliance with the civil prison, there was no liberality of the feeder to the fulfill the obligation to pay the food allowance, allowing replacement by other measures to comply with it, regardless of a new analysis of the restrictive measure of freedom, when the end of the period is decreed pandemic.
