Abstract

This article´s purpose resides on the analysis of civil compensation´s rates from a Constitutional standpoint. Therefore, the theories of constitutionalism were studied, in order to reach the true meaning of the term "new constitutionalism" in contemporary legal doctrine, resulting in a functional perspective of civil compensation and the principle of full compensation, as well as some of its legal exceptions
