Privacy in Italian Law triad of judicial decisions towards insights on conceptual limits, geographical displacement and electronic body transparency
Main Article Content
Abstract
The article deals with connections between privacy from the perspective of Italian law and the electronic body. In the first part, the reception of the term privacy in the Italian legal system, the applicable law sources and its conceptual scope were addressed. In the second part, entering the structure of three Italian court decisions, insights about conceptual limits, geographic displacement and electronic body transparency were proposed, to be considered as elements for damage verification. Given the continuous advance of new technologies, the legal privacy framework and the completion of the electronic body, the observer is required to recognize a new phenomena and revisit solutions that are apparently already crystallized. The research methodology was theoretical in an exploratory and descriptive way, making use of bibliographical technical procedures and jurisprudential analysis.
