Abstract
This article assesses civil liability imputation’s by the Superior Court of Justice for damages caused in the production chain involving pesticide products. Assuming that pesticides are demonstrably harmful, the main objective is to affirm the need for recognition of those responsible for activities involving them. For that, the research was of the bibliographical and documental type (of jurisprudence). The result obtained is that the Superior Court of Justice tends to consider the pesticide manufacturer’s responsibility for damage to the person. The conclusion is that the action of the Judiciary Power is satisfactory in agro-environmental’s protection terms, in the sense that defer claims for damages to the person for pesticides’ application are granted. Against this protection are laws and other public policies, tending to expand the use of pesticides and their respective damages.
