Abstract

This review focuses on analyzing the work of the author Charles Bicca on the possibility of civil liability to the abandonment of children. The general objective is to analyze the requirements of civil liability and its applicability in indemnity actions for affective abandonment. The specific objectives are: to analyze the historical advance of Family Law; the conflicting decisions in the courts on the subject; the theses created to weaken the theme; the concept of affective abandonment and its consequences. In these terms, it is asked: what is the unlawful act practiced by the parent or parent to evade the duty of care and what are the psychological and material consequences suffered by the victim?
