“Nothing-fantastic beings and where to find them” Disinformation about coronavirus and COVID-19 propagated by trolls, fakers, haters and bullies and the configuration of abuse of right

Abstract

In a global context already marked by disorder and informational pollution and in the face of the Coronavirus pandemic, this text aims to investigate whether the conduct of creating and spreading disinformation by trolls, faker, hater and bullies can configure (and for what reasons) the abuse of rights, provided for in art. 187, of the civil code. It is hypothesized that such conduct has full potential to constitute abuse in the exercise of the right to freedom of communication for violating good faith, social function and good customs, although other requirements need to be met. The article will studied (i) the scenario of disorder and information pollution, (ii) the agents object of study (trolls, faker, hater and bullies) and (iii) the misinformation recognized by the Brazilian Ministry of Health. The hypothetical-deductive approach method, the monographic procedure method and the indirect documentation research technique will be used.
