Gender identity, duty to inform and civil liability

Abstract

Gender identity rises as one of the most important themes to be faced by atual society to guarantee to everyone full acess to rights protected by human rights, Federal Constitution and other national laws. Besides the basic rights to health and name/gender change in
the documents, is preponderant to give for all transgenders universal rights that they are aparted because they are a minority, once we live in a society that segregate who is outside the predominant group, being even necessary to fight for the essential, as respect the right to intimacy. Even more worrying is the understanding that beyond do not respect the  elementary rights there would still be possible to require an indemnity for have not expose yourself more than the limit imposed to any other person out of this social group. This paper have exactly the goal to
expatiate about the inexistence of civil liability to
the transgender that do not reveal to your spouse
or partner that have performed surgical interventions to adapt your body to your gender identity.

Pós-doutor e Doutor em Direito pela Pontifícia Universidade Católica de São Paulo - PUC/SP e Mestre em Direito pela Universidade Metropolitana de Santos - UNIMES. Pesquisador Científico. Investigador da Rede Visões Cruzadas sobre a Contemporaneidade (Rede VCC). Associado Titular do Instituto Brasileiro de Estudos de Responsabilidade Civil (IBERC). Líder do grupo de pesquisa "Direito e Sexualidade".
