20 anos do Código Civil e os novos danos os desafios trazidos pela pandemia

Abstract

Much is questioned about the purpose and functions of liability and about the typification of new damages. During Covid-19, this discussion gained new elements arising from situations that question classical elements and clearly make useless the compensation solutions. This article, from a lecture given at the Superior Tribunal de Justiça, reflects on the new directions of liability, especially when the circumstances that occurred during the pandemic period bring important social damages. In the 20 years of the Civil Code, liability gains new contours and functions that become increasingly important for the protection of the human person.
