Abstract
This article analyzes the legal controversy regarding the period limitation applicable to cases of contractual liability, based on the recent decisions of the STJ on the subject, especially the EREsp. 1.280.825/SP, appreciated
by the 2nd. Section of the Court, which standardized the understanding to apply the tenyear prescriptive period, set forth in art. 205 CC2002, as well as the main arguments in favor of the extensive application of the triennial term of art. 206 § 3 V CC2002, dedicated to cases of noncontractual liability.
