Apology in civil liability

Abstract

The article seeks to analyze the legal effects of the apology in civil liability. To do so, it relies on legislation enacted in other countries, especially in common law jurisdictions, in order to better situate the topic within the Brazilian legal system. The research includes considerations regarding the interruption of the limitation period and the exclusion of insurance coverage, given the closeness between apologies and the admission of liability. Finally, it was found that apologetic statements, which can be useful in dispute resolution, seem to concentrate their best potential in the environment of mediation, protected by confidentiality, at least until specific legislative treatment on the subject is established.
