Abstract
This article proposes a critical reflection on the legal and meta-legal elements of Civil Liability, focusing on its relationship with Kantian ethical theory. It highlights the importance of moral principles and pure reason in the formulation of moral concepts, and underlines the need to understand damage and Civil Liability from an ethical perspective. It advocates distancing Civil Liability from the logic of mere economic compensation, focusing on the replacement of ethical and moral elements. The challenge is to reconstruct the theory of Civil Liability based on ethical values and principles of civility, maintaining its integrity and the social function of Law.
