Civil liability and the regulation of Bets

Abstract

The regulation of digital betting in Brazil, introduced by Law No. 14.790/2023, has brought significant advances in legal security and consumer protection, yet it still faces challenges in practical implementation. This study examines the legal aspects of civil liability for betting platforms, focusing on contractual transparency, data protection, and the prevention of predatory practices. The research reveals that despite progress, regulatory gaps and enforcement difficulties compromise the comprehensive protection of users, especially the most vulnerable, such as children and adolescents. Strict liability stands out as a crucial tool to ensure the integrity of contractual relationships and guarantee security in the digital environment. Moreover, the regulation contributes to tax revenue and resource allocation to essential areas, promoting a balance between the economic interests of the sector and social rights. The study concludes that the rigorous application of standards and the promotion of ethical practices are indispensable for consolidating a transparent and trustworthy market.
