Abstract

One of the great preocupations of Tort Law is the victim, which also do a role to be studied from the causal nexus: its participation to your own harm. There are participations that exclude causality, others that concur, both understood from a specific posture, that is the assumption of the risks. This figure will be dealed in a normative, qualitative manner, using doctrinal rescue and legal and judicial documents, aiming to classify it in the major categories of Tort Law and individualize it based on its own criteria.

Mestre em Direito, Justiça e Desenvolvimento pelo Instituto de Direito Público de São Paulo (IDPSP) (2022). Pós-graduado em Direito Constitucional e Processo Constitucional, em Direito Registral e Notarial, em Direito Ambiental, Processo Ambiental e Sustentabilidade, tudo pelo Instituto de Direito Público de São Paulo/Escola de Direito do Brasil (IDPSP/EDB) (2019). Pós-graduando em Direito Civil pela Faculdade de Direito de São Bernardo do Campo (FDSBC) (2023-). Graduado em Direito pela Faculdade de Direito de São Bernardo do Campo (FDSBC) (2017).
