Abstract

The editorial examines, from a consumer law perspective, the civil liability of professionals who provide aesthetic services. It highlights the commodification of the body and the influence of sociocultural and technological standards in expanding the demand for procedures, which intensifies risks and requires more rigorous regulatory responses from the law. In this context, it affirms the applicability of the Consumer Defense Code (CDC) to the relationships between users and providers, emphasizing consumer vulnerability, the enhanced duty of disclosure, and the centrality of free and informed consent. The text argues that civil liability in the aesthetic sector is multifactorial, involving technical, informational, and ethical aspects, and is aggravated by the elective nature of such procedures and by information asymmetry. It underscores the relevance of objective good faith, fiduciary duties, and the construction of the legitimately expected result, as well as the distinction between technical failure and informational failure as autonomous grounds for liability. Finally, it emphasizes that proper documentation, transparent communication, and compliance with technical and bioethical standards constitute essential elements for consumer protection and for the legal conformity of professional practice in this market.
