New trends in insurance civil liability

Abstract

Duties created by good faith principle show themselves specially important in matter of insurance. Case Law is fundamental to materialize good faith, specifying hypothesis of abuse, mainly in face of exculpating and restriction clauses. This study aims to interpret insurance through civil and constitutional principles, based on human dignity and social solidarity, in order to preserve economic balance  etween parties,  according to preventive power of civil liability.
