Abstract
The article explores some of the setbacks produced by the advent of Provisional Measure 925/2020 in the field of contractual liability and of contemporary constitutional theory. It has in the jus-sociological imagination the method and, in the case study, the methodological path. In the end, the paper concludes that the primacy of the political option over the legal option will impose a serious burden on Brazilian consumers.
