Abstract
This study focuses on the analysis of a single legal diploma, which in Portugal deals with the responsibility of the producer and the distributor for defective products placed on the market. It is verified that this responsibility is, above all, dictated by the need to safeguard the health and safety of consumers and the accountability of entrepreneurs who derive advantages from the marketing of their products for the damage that these products, when defective, cause. It also takes care to determine to what extent the consumer's invitation to the damage caused by the product may exclude or reduce the liability of the producer entrepreneur.
