Abstract
The paper presents as fundamental differences between tobacco and other substances. Reflect on the tort law of tobacco in brazilian jurisprudence and doctrine, discussing the obstacles to compensation claims in this area, which can also be used for damages caused by other substances. It deepens a new concept of tort law in order to include public damage prevention policies. Conclude that compensation for damages caused by tobacco with a reduced amount of compensation is reasonable due to the competitor's fault and that compensation for other substances or electronic equipment is not applicable, and should be excluded in the field of public policies.
