Abstract

The article examines the growing relevance of fiduciary duties - care, disclosure, and loyalty - within the framework of Brazilian civil liability, particularly in light of increasingly complex contractual relationships. Grounded in the general clause of objective good faith, such duties do not constitute enforceable obligations per se, but rather normative standards of conduct aimed at fostering cooperation, trust, and protection between parties. Their breach may give rise to indemnification, termination, or nullification of the legal transaction, with heightened significance in consumer relations and long-term contracts
